Terms of Sale
Welcome to Nice Learning. These Terms of Sale and Product Use govern the purchase, download, installation, access, and use of Nice Learning themes, plugins, reports, forms, blocks, and other products designed for use with the Moodle™ LMS.
Nice Learning is an independent product provider and is not affiliated with, endorsed by, or sponsored by Moodle Pty Ltd.
1. Product Overview
Nice Learning provides premium products designed to enhance the appearance, usability, reporting, data collection, administration, and functionality of Moodle-based learning platforms.
Nice Learning products may include:
- Themes
- Plugins
- Reports and analytics tools
- Form-building and data-collection tools
- Blocks
- Activity modules
- Documentation
- Configuration files
The specific features and components included with each product are described on the relevant Nice Learning website page or Moodle Marketplace product page.
2. License and Usage
Upon purchase, you are granted a non-exclusive, non-transferable license to use the theme:
- For your own Moodle site(s) or your organization’s internal use
- You may modify the theme for your own use
- Redistribution, resale, sublicensing, or sharing of the theme (in whole or in part) is strictly prohibited
Redistribution, resale, sublicensing, or unauthorized sharing of a Nice Learning product, in whole or in part, is strictly prohibited.
All intellectual property rights remain with Nice Learning and the original product author.
3. Pricing and Payment
- Product prices are displayed on the Nice Learning website and the Moodle Marketplace
- All Nice Learning products are sold exclusively through the Moodle Marketplace
- Payments are processed through Stripe using the payment system provided through the Moodle Marketplace
- Nice Learning does not directly collect or process customers’ payment-card information
- Prices are subject to change without prior notice
- Any applicable taxes or additional charges will be shown during checkout
4. Delivery
- After successful payment, the purchased product will be made available for download through the Moodle Marketplace
- Delivery is entirely digital
- No physical product will be shipped
- Customers are responsible for maintaining access to their Moodle Marketplace account and securely storing downloaded product files
5. Refund Policy
Due to the digital nature of Nice Learning products, refunds are generally not provided once a product has been downloaded or accessed.
However, refunds may be granted under the following circumstances:
- The product has a critical, reproducible defect that prevents it from functioning as described
- The issue cannot be resolved within a reasonable timeframe after support intervention
All refund requests are subject to review and may also be governed by the refund and dispute policies of the Moodle Marketplace and Stripe.
Nothing in this policy limits the customer’s rights under applicable consumer-protection laws or the dispute-resolution mechanisms provided by the Moodle Marketplace or payment provider.
6. Support and Updates
- Support is provided through the official Nice Learning support system using ticket submission
- We aim to respond to support requests within a reasonable timeframe but do not guarantee specific response or resolution times
- Updates, compatibility improvements, and bug fixes may be provided periodically
- Updates may be provided to maintain compatibility with supported Moodle versions
- Support and updates apply only to products and versions that are currently supported by Nice Learning
7. Compatibility
- Each Nice Learning product is designed for the Moodle versions listed on its product page
- Customers are responsible for confirming compatibility before purchasing or installing a product
- We do not guarantee compatibility with unsupported Moodle versions, third-party plugins, custom modifications, or heavily customized Moodle installations
- Compatibility with one Moodle version does not guarantee compatibility with every future Moodle version
8. User Responsibilities
You agree to:
- Use Nice Learning products in compliance with applicable laws and Moodle guidelines
- Use the products only for lawful purposes
- Not redistribute, resell, sublicense, share, or misuse the products
- Not remove or alter copyright, licence, ownership, or attribution notices
- Ensure the proper configuration and maintenance of your Moodle installation
- Create appropriate backups before installing or updating a product
- Confirm that your Moodle installation meets the product’s technical requirements
- Protect your Moodle Marketplace account and download access from unauthorized use
9. Limitation of Liability
To the fullest extent permitted by law:
- Nice Learning products are provided “as is” without warranties of any kind
- Nice Learning does not guarantee that its products will meet every customer requirement or operate without interruption or error
- Nice Learning is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of, or inability to use, a product
- Nice Learning is not responsible for data loss, system disruption, compatibility issues, or security problems caused by incorrect installation, unsupported environments, third-party products, or customer modifications
- Customers are responsible for creating backups and testing products before using them in a live or production environment
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
10. Changes to Terms
Nice Learning reserves the right to update or modify these Terms of Sale and Product Use at any time.
Updated Terms will be published on the Nice Learning website. Continued purchase or use of Nice Learning products after changes become effective constitutes acceptance of the updated Terms.
